ESTATES, PROBATE AND LETTERS OF ADMINISTRATION

When a person passes away, there are many things which need to be attended to for the purpose of their estate. Some common things include selling real estate, closing bank accounts, finalising liabilities and distributing assets in accordance with a Will (or otherwise if there is no Will). None of these can be done without first obtaining either a Grant of Probate (if the deceased had a Will) or a Grant of Letters of Administration (if the deceased did not have a Will). This Grant is obtained through the Supreme Court of the State in which the deceased lived/died.

CONTESTING A WILL OR MAKING A CLAIM ON AN ESTATE

Our firm has significant experience acting in matters relating to either contesting the validity of a deceased person’s Will or making a claim on an Estate. Both areas of law are complex and unique to each circumstance of a case. There are only certain persons who can make a claim on an Estate and very particular information and documentation to support either a claim on an Estate or the Contesting of a Will.
